Bill Summary
An act to amend Section 65585 of, and to add Section 65863.14 to, the Government Code, relating to land use.

This bill prohibits cities, counties, and cities and counties from imposing any minimum automobile parking requirements on housing development projects located within 1/2 mile of public transit. However, the local government can impose these requirements if it makes written findings within 30 days of receiving a completed application that not imposing them would have a substantially negative impact on the local government's ability to meet its share of regional housing needs for low- and very low-income households, its ability to meet housing needs for the elderly or those with disabilities, or existing residential or commercial parking within 1/2 mile of the project. The bill creates exceptions for projects that dedicate at least 20% of units to low-income or special needs households, have fewer than 20 units, or are not subject to parking requirements under other state laws. The bill also states that these provisions do not reduce or eliminate requirements for electric vehicle or disabled parking spaces.
