This bill adds a new chapter to existing Idaho law to provide for maximum fees that health care providers may charge for medical records requests. The bill defines "health care provider" to include physicians, other licensed health care practitioners, and health care facilities. It establishes a fee schedule for providing medical records in paper and electronic formats, with limits on the amount that can be charged per page, for sending the records, and for expedited electronic requests. The bill also requires health care providers to fulfill records requests within 30 days and to provide the records in the format specified by the requestor, if available. The bill has an emergency clause and takes effect on July 1, 2022.
