This bill adds a new section to existing Idaho law to prohibit the unfair collection of residential rental application fees. Specifically, it defines "making undue profit" as charging more than $25 over the actual costs of screening an applicant, collecting and retaining fees when no rental property is available or when there is no intention to consider the applicant, and failing to refund application fees within 48 hours if the applicant has not been screened. The bill also states that real estate brokers and salespeople are not considered to make undue profit if they receive a commission or fee. Violations of this law will be subject to penalties under the Consumer Protection Act.
