This bill, the Fair Social Security for Domestic Violence Survivors Act, amends the Social Security Act to modify the 10-year marriage rule for spouse's and surviving spouse's insurance benefits in cases of domestic violence. Under the new provisions, the marriage duration requirement is reduced from 10 years to 5 years if the divorced spouse can provide a court finding that they were a victim of domestic violence committed by their spouse during the marriage. The definition of "domestic violence" is taken from the Violence Against Women Act of 1994. The amendments made by this bill will apply to monthly insurance benefits for months beginning at least 18 months after the date of enactment.
