This bill prohibits price discrimination in commercial transactions in Minnesota. Specifically, it prohibits a person engaged in commerce from directly or indirectly discriminating in price between different purchasers of commodities of like grade and quality, if the discrimination lessens competition or tends to create a monopoly or monopsony (a market with a single buyer). The bill provides exceptions for differentials that account for differences in the cost of manufacture, sale, or delivery, as well as for certain other market changes. The bill also shifts the burden of proof, requiring the person charged with a violation to affirmatively demonstrate justification for the price discrimination. Finally, the bill repeals an existing Minnesota law on discrimination in the sale of printed or mimeographed materials.
