This bill amends Chapter 3 of the General Laws to establish new requirements for public entities, including the Commonwealth and its agencies, to use or dispose of land, easements, or other real property interests that are subject to Article XCVII of the Amendments to the Constitution of the Commonwealth (also known as the "Environmental Rights Amendment"). The key provisions require public entities to conduct an alternatives analysis, identify replacement land or funding of equal or greater value, and obtain approval from the General Court before using or disposing of these protected properties. The Secretary of Energy and Environmental Affairs is also granted the authority to waive or modify certain requirements in specific circumstances.
