Specifically, it changes the offense from a fourth-degree crime to a third-degree crime if the person takes, operates, or exercises control over a motor vehicle without the owner's consent. Additionally, it changes the offense from a third-degree crime to a second-degree crime if the person takes, operates, or exercises control over a motor vehicle without the owner's consent and operates the vehicle in a manner that creates a risk of injury or property damage.
