Bill Summary
AN ACT to amend the penal law and the cannabis law, in relation to including certain acts and subsequent penalties in the criminal sale of cannabis
AI Summary
This bill amends the Penal Law and the Cannabis Law to include certain acts and subsequent penalties in the criminal sale of cannabis. Specifically, the bill adds two new provisions to the existing laws: 1) It makes it a criminal offense for any person, while employed or operating a commercial establishment, store, club, or facility, to knowingly and unlawfully sell, transfer, gift, or trade cannabis without an appropriate license or authority under the Cannabis Law. Conviction under this provision would preclude the person from seeking or receiving any permit, license, or authority to perform activities under the Cannabis Law. 2) It establishes civil penalties for commercial establishments, stores, clubs, or facilities that knowingly and unlawfully sell, transfer, gift, or trade any amount of cannabis without an appropriate license or authority. The civil penalties range from $10,000 for a first violation to $50,000 for a third and subsequent violations.
