This bill, the "My Body, My Data Act of 2022," aims to protect the privacy of personal reproductive or sexual health information. It does this by: 1) Limiting the collection, retention, use, and disclosure of such information by "regulated entities" (which includes most businesses) to only when the individual has given express consent or when strictly necessary to provide a requested product or service. 2) Requiring regulated entities to provide individuals with the ability to access and delete their personal reproductive or sexual health information retained by the entity. 3) Mandating regulated entities to have a clear and transparent privacy policy describing their practices around this information. The bill is enforceable by the Federal Trade Commission as well as through civil lawsuits by individuals. It also preserves the authority of existing federal and state privacy laws, and carves out an exception for the publication of newsworthy information.
