This bill requires the owner or operator of a "high hazard train" (a train transporting a large volume of petroleum, petroleum products, or other hazardous substances) traveling in New Jersey to submit a discharge response, cleanup, and contingency plan to the Department of Environmental Protection. The plan must contain details on emergency response measures, available equipment, personnel qualifications, and priorities for protecting sensitive environmental areas. The bill also requires the owner/operator to provide training to local emergency services personnel, meet certain response time requirements following a discharge, and maintain evidence of financial responsibility. The bill grants the Department authority to enforce these requirements through civil administrative penalties and legal action. Additionally, the bill requires the Department to annually request bridge inspection reports from the U.S. Department of Transportation for bridges owned by railroads or where railroads are located and provide those reports to the Governor and Legislature.
