This bill establishes the "New Jersey Feminine Hygiene Product Donations Immunity Act." The key provisions of the bill are: 1) It provides immunity from civil or criminal liability for good faith donors of feminine hygiene products (such as sanitary napkins, tampons, etc.) to charitable or nonprofit organizations, as well as for the organizations and their employees/volunteers who receive and distribute the donated products, unless the injury or death is a direct result of gross negligence, recklessness, or intentional misconduct. 2) It applies to donations of products that are "apparently usable" but may not be readily marketable due to appearance, surplus, or other conditions. 3) The Commissioner of the Department of Community Affairs is directed to adopt rules and regulations to implement the provisions of the Act.
