This bill upgrades penalties for certain crimes involving heroin and fentanyl, establishes new crimes concerning heroin mixtures, and allows certain defendants convicted of first-degree crimes involving heroin, heroin mixtures, or fentanyl to be eligible for drug court sentencing under certain circumstances. Specifically, the bill increases the quantity thresholds for first- and second-degree crimes involving heroin and fentanyl, creates a new crime for "heroin mixtures" containing heroin and at least one other controlled dangerous substance, and allows defendants convicted of first-degree crimes involving smaller quantities of these substances to be eligible for the special probation drug court program if they are not considered "drug profiteers."
