This bill requires sellers of real property and landlords to make certain notifications regarding flooding. Specifically, it requires landlords to notify tenants prior to lease signing or renewal whether the rental property is located in a FEMA-designated flood hazard area and if the landlord has knowledge of the property being subjected to flooding. The bill also requires sellers to disclose in the property condition disclosure statement whether the property is located in a flood hazard area and any other known flood risks. The Department of Community Affairs, in consultation with the Department of Environmental Protection, is tasked with developing a model notice for landlords and making updates to the property condition disclosure statement. The bill also provides remedies for tenants who suffer substantial losses due to flooding after a landlord's failure to disclose.
