This bill allows for a complaint for guardianship of a minor under the age of 18 who is receiving developmental disability services to be filed up to 180 days before the minor reaches the age of 18. The bill also establishes certain standards for filing such guardianship complaints, including that the complaint and accompanying documentation shall not be withdrawn absent a showing that the individual is deceased or has regained capacity, and that this showing may be satisfied by the testimony of the applicant or other witness without requiring medical evidence. The bill also provides that any judgment designating a guardian shall take effect no earlier than the date the minor attains the age of 18.
