This bill amends the Education Code to address the possession, use, or delivery of marijuana or e-cigarettes on or near public school property or at certain school events. The key provisions are: 1. It clarifies that a student shall be removed from class and placed in a disciplinary alternative education program if they possess, use, or are under the influence of, or sell, give, or deliver marijuana or tetrahydrocannabinol (THC), or possess, use, sell, give, or deliver an e-cigarette on or within 300 feet of school property or at a school-related activity. 2. It requires that if a disciplinary alternative education program is at capacity when a student engages in conduct involving marijuana, THC, or e-cigarettes, the student shall be placed in in-school suspension until a position becomes available in the program. 3. It allows a student placed in the disciplinary alternative education program for conduct involving marijuana, THC, or e-cigarettes to be removed and placed in in-school suspension to make room for a student who engaged in violent conduct, if the program is at capacity. The bill takes effect on September 1, 2023.
