This bill, the Informing Consumers about Smart Devices Act, requires manufacturers of certain internet-connected consumer products (known as "covered devices") to clearly disclose whether the device contains a camera or microphone as a component. The Federal Trade Commission (FTC) will enforce this disclosure requirement as a violation of unfair or deceptive practices, with penalties and enforcement powers similar to the Federal Trade Commission Act. The FTC is also required to issue guidance to assist manufacturers in complying with the disclosure requirement. The bill excludes certain devices, such as phones and devices specifically marketed as cameras or microphones, from the disclosure requirement. The bill will apply to covered devices manufactured 180 days after the FTC issues its guidance.
