This bill amends the Health and Safety Code to change the penalty for certain offenses involving the possession of a small amount of certain controlled substances. Specifically, it reduces the penalty for possessing less than one gram of a controlled substance in Penalty Group 1 from a state jail felony to a Class A misdemeanor with a minimum term of confinement of 180 days. However, the penalty remains a state jail felony if the person has been previously convicted of certain drug offenses. The bill also adds a defense to prosecution for individuals who request emergency medical assistance during an overdose. Additionally, the bill allows a judge to require certain offenders to complete a substance abuse education program as a condition of community supervision.
