This bill, known as the Bipartisan Approach to Legislative Authority Necessary in Continuing Emergencies (BALANCE) Act of 2023, aims to establish balanced legislative oversight of gubernatorial powers during a declared emergency. It amends existing laws to allow the state legislature to terminate a declared state of emergency through a concurrent resolution, or if the legislature is not in session, through a written termination by the four leaders of the senate and house. The bill also limits the governor's ability to waive or suspend statutory obligations or limitations during a state of emergency to 30 days, unless extended by the legislature through a concurrent resolution or, if the legislature is not in session, by the legislative leaders in writing.
