Bill Summary

An act to add Section 22945.5 to the Business and Professions Code, relating to social media platforms.

AI Summary

This bill would authorize a person to seek a court order requiring a social media platform to remove content that includes an offer to transport, import, sell, furnish, administer, or give away a controlled substance in violation of California's drug laws. If the social media platform has a reporting mechanism for illegal or harmful content, the person must first notify the platform and request removal through that mechanism before seeking a court order. The court can dismiss the action if the platform deletes the content within 48 hours of receiving the notice. The bill also provides for the award of court costs and reasonable attorney's fees to a prevailing plaintiff, and potentially to a prevailing defendant if the court finds the plaintiff's action was not brought in good faith.
