This bill, the Eliminating Backlogs Act of 2022, aims to preserve expiring employment-based visas and make them available for issuance during fiscal year 2023. Specifically, it would increase the worldwide level of employment-based immigrants by the difference between the number of visas originally made available to family-sponsored immigrants from 1992 to 2021 and the number of employment-based immigrants who received visas during those years. The Secretary of State, in consultation with the Secretary of Homeland Security, would allocate these additional visas proportionally based on the existing employment-based visa categories and would not subject them to the per-country numerical limitations. The visas would remain available until they are issued and used as the basis for an application for admission into the United States.
