This bill allows for the resentencing of individuals who were sentenced as a persistent offender or received an exceptional sentence pursuant to a plea agreement intended to avoid a persistent offender sentence, if a conviction for robbery in the second degree was used as a basis for the persistent offender finding. The bill specifies that robbery in the second degree shall not be considered a most serious offense for the purposes of resentencing, regardless of when the offense was committed. The bill also requires the administrative office of the courts and the department of corrections to provide plea agreement data to the office of public defense, which will then analyze the data and notify eligible individuals of their eligibility for resentencing.
