This bill amends existing law to allow for the death penalty to be charged against inmates who commit murder while already incarcerated. Under the new provisions, if a person is charged with aggravated first-degree murder committed while already serving a term of incarceration, the prosecuting attorney must submit the case to a newly established "death penalty review panel" for a determination on whether the death penalty should be sought. If the panel recommends pursuing the death penalty, the prosecutor must file a notice of a special sentencing proceeding to determine if the death penalty should be imposed.
