This bill amends the existing law (RCW 51.36.070) to provide additional rights and protections for injured workers during compelled medical examinations ordered by the Department of Labor and Industries (the Department) or a self-insured employer. The key provisions include: (1) allowing the worker to record the audio, video, or both, of the compelled examination, with the worker responsible for the recording costs; (2) requiring the worker to provide a copy of the recording to the Department or self-insured employer upon request, but not before the issuance of the written examination report; (3) allowing the worker to have one observer, who is at least the age of majority and of the worker's choosing, present during the compelled examination; and (4) applying these new provisions prospectively to all claims, regardless of the date of injury.
