This bill amends existing law to provide requirements for post-election audits ordered by the Secretary of State. The key provisions include: (1) the Secretary of State must identify and order post-election audits of certain paper ballots after county canvasses, including a hand recount and comparison to reported results; (2) the audits may be ordered for federal elections, the gubernatorial election, the statewide office election with the narrowest margin, the statewide ballot question election with the narrowest margin, and one legislative office election per county; (3) the precincts selected for audit must be chosen randomly and cannot exceed 5% of the precincts or one precinct per county, with exceptions; (4) the Secretary of State can select days, batches, legislative districts, and tabulation machines of early or absentee ballots for audit in certain counties; and (5) the Secretary of State must report the audit results and can order additional audits based on the findings. The bill also declares an emergency and provides an effective date of July 1, 2023.
