This bill amends the Uniform Controlled Substances Act in West Virginia. It creates two new criminal offenses: (1) Delivering a controlled substance that proximately causes the death of the user, which is punishable by 3 to 15 years in prison; and (2) Failing to seek medical assistance when another person suffers an overdose or significant adverse reaction to a controlled substance, resulting in that person's death, which is punishable by 1 to 5 years in prison. The bill defines "engaged in the illegal use of a controlled substance with another person" and "seek medical assistance" to provide clarity on the new offenses.
