This bill creates two new criminal offenses in New Mexico: "Negligently Making a Firearm Accessible to a Minor" and "Negligently Making a Firearm Accessible to a Minor Resulting in Great Bodily Harm or Death." The first offense is a misdemeanor and applies when a person keeps or stores a firearm in a way that negligently disregards a minor's ability to access it, and the minor then displays or brandishes the firearm in a threatening manner or causes injury. The second offense is a fourth-degree felony and applies when a person keeps or stores a firearm in a way that negligently disregards a minor's ability to access it, and the minor then uses the firearm to cause great bodily harm or death. The bill provides several exceptions, such as when the firearm is kept in a locked container, on the person, or with the authorization of the minor's parent or guardian.
