This bill amends the Penal Code to modify the affirmative defenses available for certain offenses involving material or conduct that is obscene or otherwise harmful to children. Specifically, it expands the affirmative defense to include situations where the sale, distribution, or exhibition was for a bona fide judicial, law enforcement, or legislative purpose, rather than just scientific, educational, governmental, or similar purposes. It also modifies the affirmative defense for prosecution related to the sexual exploitation of a child to include situations for a bona fide judicial, law enforcement, or legislative purpose, rather than just educational, medical, psychological, psychiatric, or similar purposes. The changes in law made by this bill apply only to offenses committed on or after the effective date of September 1, 2023.
