This bill amends the New Mexico Medical Malpractice Act to update the caps on the aggregate dollar amount recoverable for injuries or deaths resulting from medical malpractice. Specifically, it sets a cap of $600,000 per occurrence for claims against health care providers prior to January 1, 2022, and $750,000 per occurrence for claims against independent providers or outpatient health care facilities not majority-owned by a hospital, with annual adjustments for inflation starting in 2023. For claims against hospitals or outpatient facilities majority-owned by hospitals, the cap starts at $4 million per occurrence in 2022 and gradually increases to $6 million per occurrence by 2027, also with annual inflation adjustments. The bill also clarifies that the cap applies to all claims, including loss of consortium claims, arising from a single occurrence, and that juries will not be instructed on the cap.
