This bill creates and enacts new sections of the North Dakota Century Code related to legal nonconforming structures in counties, cities, and townships. The key provisions allow a legal nonconforming residential structure that is damaged beyond 50% of its value to be repaired, replaced, improved, maintained, restored, or rebuilt in its entirety, as long as certain conditions are met, such as submitting a building permit application within six months, beginning restoration within one year, and the new structure not exceeding the size or footprint of the damaged structure. The bill also allows local zoning authorities to create less restrictive ordinances or regulations for these structures and requires them to regulate legal nonconforming structures in floodplain areas to maintain eligibility in the National Flood Insurance Program.
