This bill amends the criminal penalties for possession or delivery of marihuana concentrate in Texas. It defines "marihuana concentrate" as the resin extracted from marihuana and introduces new weight thresholds for classifying possession or delivery offenses involving marihuana concentrate separately from offenses involving other forms of marihuana. The bill also provides an affirmative defense for certain delivery offenses involving small amounts of marihuana concentrate. The changes in this bill apply only to offenses committed on or after September 1, 2023.
