This bill establishes a new section in Utah law that requires local education agencies (LEAs) to provide paid parental leave and postpartum recovery leave to eligible employees, which includes birth parents, adoptive parents, parents through gestational agreements, and legal guardians. The bill sets a minimum amount of leave that must be provided, equivalent to what is available to state employees, and allows for part-time and overtime employees to use the leave on a pro-rata basis. LEAs must develop leave policies by July 1, 2025, that include a leave sharing mechanism allowing employees to donate leave for use by qualified employees. The bill also prohibits retaliatory actions against employees who use the leave, and takes effect on July 1, 2023.
