This bill amends the Texas Penal Code to change the definition of a "child" from a person younger than 17 years of age to a person younger than 18 years of age. It also modifies the existing law on making a firearm accessible to a child, providing additional affirmative defenses and exceptions, and increasing the criminal penalty to a felony of the third degree if the child's discharge of the firearm causes death or serious bodily injury to someone who does not reside with the child. The changes in this bill apply only to offenses committed on or after the effective date of September 1, 2023.
