This bill amends the Public Utilities Act to require a referendum if a large public utility (defined as an investor-owned utility that regularly provides water or sewer service to more than 15,000 customer connections) seeks to acquire a water or sewer utility owned by the state or a political subdivision. The referendum would allow electors in the service area of the water or sewer utility to vote on whether the acquisition can proceed. The bill also outlines the procedures for determining the fair market value of the water or sewer utility and the ratemaking treatment for the acquired utility.
