Bill Summary

Distributed Generation Facility Supply Cap

AI Summary

This bill amends a section of the New Mexico Public Utility Act to clarify that a person who owns or controls a renewable energy distributed generation facility (REDGF) that meets certain criteria, such as being located on the host's site and producing electricity used by the host or the host's tenants or employees, shall not be deemed a public utility subject to the jurisdiction of the Public Utility Commission. The bill also removes a provision that previously limited the size of the REDGF to no more than 120% of the average annual electricity consumption at the host's site.
