This bill amends the New Mexico Telecommunications Act to require that incumbent local exchange carriers (ILECs) serving 50,000 or more access lines be regulated in the same manner as incumbent rural telecommunications carriers, with some exceptions. It establishes that effective competition exists in a wire center serving area when voice services are provided by two or more alternate providers, regardless of the technology used or whether the providers receive state or federal funding. The bill also requires the Public Regulation Commission to report on the steps taken to achieve regulatory parity among carriers and allows the Commission to reregulate basic local exchange service in certain deregulated areas if necessary to protect the public interest.
