This bill aims to address cost-sharing for prescription drug coverage in New Mexico. The key provisions are: 1. Insurers must credit enrollees for the full value of any discounts or payments made by third parties when calculating the enrollee's cost-sharing obligation for covered prescription drugs. 2. Beginning in 2024, insurers cannot charge different cost-sharing amounts for prescription drugs or pharmacy services obtained at non-affiliated pharmacies or for administration of prescription drugs at different infusion sites, though they can communicate with enrollees about lower-cost options. 3. Beginning in 2024, insurers cannot require enrollees to pay more at the point of sale for a covered prescription drug than the least of the applicable cost-sharing amount, the amount the enrollee would pay without insurance, the total pharmacy reimbursement amount, or the value of the manufacturer's rebate. 4. The bill also prohibits pharmacy benefits managers and third parties from discriminating against 340B drug program participants by paying them lower reimbursement rates or imposing additional fees or restrictions on them.
