This bill amends the Business & Commerce Code and the Government Code to restrict the release of mug shots to the public. The bill prohibits businesses from publishing criminal record information if an expunction or nondisclosure order has been issued, or if the information cannot be released under the new Section 552.1082 of the Government Code. Section 552.1082 prohibits the release of mug shots, with exceptions for individuals convicted of certain offenses, individuals who are fugitives or pose an imminent threat, and cases where a judge orders the release based on a legitimate law enforcement interest. The bill applies to mug shots regardless of when they were created and takes effect immediately or on September 1, 2023, depending on the vote.
