This bill, known as the Maryland Defend Our Guard Act, prohibits the Governor from ordering the Maryland militia or any of its members into active duty combat unless the U.S. Congress has passed an official declaration of war or taken an official action to call forth the state militia to execute the laws, repel an invasion, or suppress an insurrection. The bill defines "active duty combat" as participation in an armed conflict, performance of a hazardous service relating to an armed conflict in a foreign state, or performance of a duty through an instrumentality of war. However, the bill does not limit the Governor's ability to deploy the militia or its members for U.S. defense support of civil authorities within the United States and its territories.
