This bill amends the existing law in South Dakota to require an official declaration of war or other Congressional action before the South Dakota National Guard can be deployed outside of the state. Specifically, the bill prohibits the South Dakota National Guard from being released for active service in a foreign armed conflict, performing hazardous service related to a foreign armed conflict, or executing the laws of the Union, repelling an invasion, or suppressing an insurrection, unless the U.S. Congress has issued a formal declaration of war or taken official action to call forth the National Guard for those purposes as outlined in the U.S. Constitution.
