This bill, the Secure Access For Essential Reproductive Health Act of 2023 or the SAFER Health Act of 2023, aims to ensure the privacy of pregnancy termination or loss information under the Health Insurance Portability and Accountability Act (HIPAA) privacy regulations and the Health Information Technology for Economic and Clinical Health (HITECH) Act. The key provisions of the bill prohibit covered entities and their business associates from disclosing an individual's pregnancy termination or loss information in any proceedings, except in limited circumstances, such as for the defense of a professional liability action or to investigate physical harm related to the loss or termination of the pregnancy. The bill also requires the Secretary of Health and Human Services to revise certain HITECH regulations to ensure that the practice of not fulfilling requests to access, exchange, or use electronic health information containing pregnancy termination or loss information is not considered information blocking, and to require health IT developers to implement practices that allow for the segregation of such data.
