Bill Summary
AN ACT to amend the correction law, in relation to enacting the "gender identity respect, dignity and safety act"
AI Summary
This bill enacts the "gender identity respect, dignity and safety act", which requires state and local correctional facilities to address incarcerated individuals by their gender identity, provide them access to commissary items and materials consistent with their gender identity, allow them to be searched by staff of the gender most closely aligned with their identity, and guarantee their access to appropriate medical and mental health care. The bill also establishes a presumption that incarcerated individuals will be placed in facilities with individuals of the gender most closely aligned with their identity, unless they opt out or there is clear evidence they pose a current danger of gender-based violence. The bill prohibits discriminatory denials of this presumptive placement and requires annual reporting on relevant data.
