This bill amends the definition of "state-mandated health benefits" for the purposes of consumer choice of benefits plans. It expands the definition to include coverage or features required by state law, such as standard provisions or rights unrelated to a specific health condition, as well as requirements that exceed federal standards. The bill also clarifies that state-mandated benefits do not include standard provisions or rights that are also required in a basic coverage plan under state law. The changes made by this bill will apply to standard health benefit plans delivered, issued, or renewed on or after January 1, 2024, with plans before that date being governed by the previous law.
