This bill makes the following key changes: 1. Requires judges and magistrates to set minimum bail amounts for certain violent felony offenses, ranging from $5 million for capital offenses to $2 million for second-degree felonies. It also allows victims to sue judges or magistrates who set bail below the minimum amounts. 2. Creates a new criminal offense punishable by a fine of up to $4,000 (or $10,000 for repeat offenders) for judges or magistrates who set bail below the minimum amounts or release defendants accused of committing a felony while on bail for a prior felony. 3. Increases the minimum term of imprisonment for certain felonies committed while the defendant was released on bail for a prior felony, from 5 years to the greater of 5 years or the minimum term provided by law for the offense. It also makes these defendants ineligible for deferred adjudication, mandatory supervision, and early parole. The bill will only take effect if a related constitutional amendment is approved by Texas voters.
