Bill Summary
AN ACT to amend the general business law, in relation to price gouging
AI Summary
This bill amends the New York General Business Law to define "unconscionably excessive price" for the purposes of prohibiting price gouging during an abnormal disruption of the market. The bill provides specific criteria for determining when a price is not considered "unconscionably excessive," including if it is within 10% of the seller's pre-emergency price, comparable prices outside the emergency area, the seller's acquisition/replacement cost plus their usual markup, or reflects fluctuations in regional/national commodity markets. The Attorney General can seek injunctions and civil penalties for violations of the price gouging prohibition.
