This bill amends the Civil Practice Law and Rules to modify the distribution of funds realized through asset forfeiture. The key provisions are: (1) 40% of remaining forfeiture funds (after other distributions) will go to the Chemical Dependence Service Fund; (2) 15% of remaining forfeiture funds will go to the claiming authority to cover investigation, preparation, and litigation costs; and (3) 5% of remaining forfeiture funds will go to the claiming authority to cover costs of protecting, maintaining, and forfeiting the property. The bill removes previous provisions allocating 15% and 5% of forfeiture funds to the claiming authority for these purposes.
