This bill creates a new "due process special education aid" for school districts to provide time for teachers to complete due process forms and procedures related to individualized education programs (IEPs) and individualized family service plans (IFSPs). The bill sets the amount of this aid based on the district's adjusted pupil units, and requires districts to negotiate an agreement with the exclusive representative of teachers on how to use the aid, such as providing paid time for teachers or hiring dedicated due process staff. If the district and teachers cannot reach an agreement, the aid must be used to provide paid time for teachers providing direct special education services. The bill also appropriates funds from the general fund to the Department of Education to provide this new special education due process aid to school districts.
