This bill amends the New York Labor Law to prohibit the inclusion of contract provisions that waive an employee's substantive or procedural rights related to claims of discrimination, non-payment of wages or benefits, retaliation, harassment, or violation of public policy in employment. It deems such provisions "unconscionable, void and unenforceable," and prohibits employers from retaliating against employees who refuse to enter into such agreements. The bill also prohibits the concealment of details related to these types of employment claims, including those submitted to arbitration. It provides for civil action, attorney's fees, and other remedies for violations. The bill's provisions do not apply to collective bargaining agreements.
