Bill Summary
AN ACT to amend the public health law, in relation to establishing the born alive abortion survivors' protection act
AI Summary
This bill establishes the "Born Alive Abortion Survivors' Protection Act" in New York. It requires healthcare practitioners present during an abortion or attempted abortion procedure to exercise the same degree of skill, care, and diligence to preserve the life and health of a child born alive as they would for any other child born at the same gestational age. The healthcare practitioner must then ensure the child is immediately transported and admitted to a hospital. The bill also allows the mother of the child born alive to seek civil relief, including actual damages, statutory damages, and punitive damages, if there is a violation of these requirements. Failure to report a violation is a class A misdemeanor, and intentionally killing or attempting to kill the child born alive can result in criminal charges under the Penal Law.
