This bill establishes: 1) A cause of action for nonconsensual dissemination of deep fake sexual images, allowing victims to sue for damages, seek injunctions, and have confidential filings to protect their privacy. There are some exceptions for lawful purposes like criminal investigations, reporting of unlawful conduct, and commercial sales. 2) A crime for using deep fake technology to influence an election, with penalties of up to 5 years in prison or a $10,000 fine if committed within 5 years of a previous conviction, or up to 90 days or a $1,000 fine in other cases. Injunctive relief may also be available. 3) A crime for nonconsensual dissemination of deep fake sexual images, with penalties of up to 3 years in prison or a $5,000 fine if certain aggravating factors are present, such as the victim suffering financial loss or the dissemination being done with intent to harass. Certain lawful purposes like reporting unlawful conduct are exempted. The bill proposes coding these new provisions into Minnesota law, with an effective date of August 1, 2023.
