Bill Summary

An act to amend Sections 113755 and 114381 of the Health and Safety Code, relating to temporary food facilities.

AI Summary

This bill would: 1) Expand the definition of a "community event" under the California Retail Food Code to include farmers' markets and night markets conducted for up to 90 consecutive or non-consecutive days in a 12-month period. This would allow temporary food facilities operating at these events to obtain a specialized "farmers' market or night market temporary food facility permit" that is valid for all locations of that community event. 2) Require the Franchise Tax Board to establish a program for making periodic advance payments to eligible taxpayers of up to 80% of their estimated earned income tax credit, young child tax credit, and foster youth tax credit. The bill would allow taxpayers to report changes to their personal information to adjust the estimated credit amounts, and would require taxpayers to repay any excess advance payments over $300. 3) Require the Franchise Tax Board to request federal waivers to exclude these advance credit payments from being counted as income for determining eligibility or calculation of benefits under various federal assistance programs. The bill would impose state-mandated local program costs and make an appropriation by authorizing additional payments from the Tax Relief and Refund Account.
